General Terms and Conditions of Sale for Products Sold on bolamba.cm

Article 1 - Purpose
These terms and conditions govern the sale of products by CAMPOST, marketed through the bolamba website.
Article 2 - Prices
Prices for our products are indicated in XAF FCFA, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise stated, and exclude processing and shipping fees.
For orders to countries other than Cameroon, you are the importer of the product(s) in question. Customs duties or other local taxes, import duties, or state taxes may be payable. These duties and sums are not the responsibility of CAMPOST. They will be your responsibility and are under your full liability, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of origin, are payable in XAF. The website will perform currency exchange operations where necessary.
CAMPOST reserves the right to modify its prices at any time, but the product will be invoiced based on the price in effect at the time the order is validated, subject to availability.
Products remain the property of CAMPOST until full payment of the price.
Caution: As soon as you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.
Article 3 - Orders
You can place orders:

Contractual information is presented in French and English and will be confirmed at the latest at the time of validation of your order.
CAMPOST reserves the right not to register a payment and not to confirm an order for any reason whatsoever, and more particularly in case of supply problems or difficulties concerning the order received.
Article 4 - Order Validation
Any order appearing on the Bolamba website implies acceptance of these General Terms and Conditions. Any order confirmation implies your full and unreserved acceptance of these general terms and conditions of sale, without exception or reservation.
All data provided and the recorded confirmation will constitute proof of the transaction.
You declare to have perfect knowledge of this.
Order confirmation will constitute signature and acceptance of the operations carried out.
A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the email address confirming your order.
Article 5 - Payment
Validating your order implies your obligation to pay the indicated price.
Payment for your purchases is made by credit card or through secure payment systems.
The card is only debited at the time of order invoicing.

Article 6: Right of Withdrawal
In accordance with Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from the date of receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, you are responsible. Any damage suffered by the product during this process may invalidate the right of withdrawal.
Return shipping costs are your responsibility.
In the event of exercising the right of withdrawal, CAMPOST will refund the amounts paid within 14 days of notification of your request and via the same payment method used during the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:
- The supply of services fully performed before the end of the withdrawal period and whose execution began after the express prior consent of the consumer and express waiver of their right of withdrawal.
- The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period.
- The supply of goods made to the consumer's specifications or clearly personalized.
- The supply of goods liable to deteriorate or expire rapidly.
- The supply of goods that have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons.
- The supply of goods which, after delivery and by their nature, are inseparably mixed with other items.
- The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose agreed value at the conclusion of the contract depends on fluctuations in the market beyond the control of the professional.
- The supply of audio or video recordings or computer software when unsealed by the consumer after delivery.
- The supply of a newspaper, periodical or magazine, except for subscription contracts to these publications.
- Transactions concluded at a public auction.
- The supply of digital content not supplied on a tangible medium whose execution began after the express prior consent of the consumer and express waiver of their right of withdrawal.
Article 7: Availability
Our products are offered as long as they are visible on the Bolamba website and while stocks last. For products not held in stock, our offers are subject to availability from our suppliers.
In the event of product unavailability after placing your order, we will inform you by email. Your order will be automatically cancelled and no bank debit will be made.
Furthermore, the Bolamba website is not intended to sell its products in large quantities. Consequently, Campost reserves the right to refuse orders of more than 10 identical items.
Article 8: Delivery
Products are delivered to the delivery address indicated during the order process, within the timeframe indicated on the order confirmation page.
In case of shipping delays, an email will be sent to inform you of any potential impact on the delivery time indicated.
In accordance with legal provisions, in case of late delivery, you have the option to cancel the order under the terms and conditions defined in Article L 138-2 of the French Consumer Code. If you receive the product in the meantime, we will refund the price of the product and the shipping costs in accordance with Article L 138-3 of the French Consumer Code.
In the case of deliveries by a carrier, CAMPOST cannot be held responsible for delivery delays due exclusively to the customer's unavailability after several proposed delivery appointments.
Article 9: Warranty
All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, as provided for in articles 1641 and following of the French Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged or refunded.
All claims, requests for exchange or refund must be made by email/phone/post within 30 days of delivery.
Products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions...). The shipping costs will be reimbursed based on the invoiced rate, and the return costs will be reimbursed upon presentation of proof.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 10: Liability
The products offered comply with current French legislation. CAMPOST's liability cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you intend to order.
Furthermore, CAMPOST cannot be held liable for damages resulting from misuse of the purchased product.
Finally, CAMPOST cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, including service interruption, external intrusion or the presence of computer viruses.
Article 11: Applicable Law in Case of Disputes
The language of this contract is French. These terms and conditions of sale are governed by French law. In case of dispute, the French courts shall have sole jurisdiction.
Article 12: Intellectual Property
All elements of the Bolamba website are and remain the intellectual and exclusive property of CAMPOST. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, elements of the site whether they are software, visual or sound. Any simple link or hyperlink is strictly prohibited without the express written consent of CAMPOST.
Article 13: Personal Data
CAMPOST reserves the right to collect nominative information and personal data concerning you. This is necessary for the management of your order, as well as for the improvement of the services and information we send you.
This data may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.
This information and data are also kept for security purposes, in order to comply with legal and regulatory obligations.
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and oppose nominative information and personal data concerning you, directly on the website.
Article 14: Archiving and Proof
CAMPOST will archive order forms and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of Article 1348 of the French Civil Code
